GENERAL TERMS AND CONDITIONS FOR DONATIONS

THROUGH THE SYMBOLIC CHARITY E-SHOP SKUTOCNYDARCEK.SK

 

ARTICLE 1.

INTRODUCTORY PROVISIONS

  1. The purpose of these General Terms and Conditions for Donations through the symbolic charity e-shop skutocnydarcek.sk (hereinafter referred to as "GTC") is to regulate the mutual relationships between the non-profit organization Človek v ohrození, n.o. as the Donee and the Donor when providing a Donation for the purpose of generally beneficial services, through the Charity e-shop as a donor portal on the website www.skutocnydarcek.sk, which is operated by the Donee.

 

  1. The GTC shall apply to every Donation provided through the Charity e-shop and related relationships.

 

  1. The Charity e-shop enables the Donor to donate a Donation to the Donee for the specified purpose of providing generally beneficial services. The Charity e-shop provides a platform whose purpose is to enable interaction between the Donor and the Donee when providing a Donation. The Donor shall familiarize themselves with all necessary information, in particular, but not limited to, these GTC, the information provided in the offer of the relevant Real Gift, as well as other necessary information published on the websites www.skutocnydarcek.sk and www.clovekvohrozeni.sk. In case of any questions, prospective Donor may contact the Donee at darcek@clovekvohrozeni.sk.

 

ARTICLE 2.

BASIC TERMS

  1. Donee is a non-profit organization providing generally beneficial services: Človek v ohrození, n.o., with its registered office at Baštová 343/5, 811 03 Bratislava, ID No.: 5008 2001, registered by the District Office of Bratislava, Tomášikova 46, 832 05 Bratislava (supervisory authority), under number OVVS-24106/502/2017-NO, Tax ID number: 2120195154. As part of its mission, the Donee provides help people affected by conflict, natural disasters, or poverty to live with dignity. It responds to crisis situations and supports the long-term development of communities in Slovakia and around the world. The Donee's vision is that every person has the right to a dignified life in which they are respected and their basic needs and human rights are fulfilled in a society that values everyone, promotes equality, and embraces diversity. In order to fulfil its mission and vision, secure funding for its charitable activities, and promote awareness and solidarity, the Donee operates a Charity e-shop. The general contact email address of the Donee is darcek@clovekvohrozeni.sk. Information about the Donee and its activities and assistance programs is available on the website www.clovekvohrozeni.sk.

 

  1. Donor is a natural or legal person who agrees to the GTC and voluntarily and gratuitously undertakes to provide a Donation to the Donee through the Charity e-shop in the manner specified by these GTC and concludes the Agreement with the Donee.

 

  1. Agreement is a donation agreement pursuant to Section 628 et seq. of Act No. 40/1964 Coll. Civil Code, as amended, concluded between the Donee and the Donor upon the provision of the Donation by the Donor to the Donee. The Donor voluntarily undertakes to provide the Donation to the Donee gratuitously, and the Donee gratefully accepts this Donation. The Donation shall be used in accordance with the Donor's designation, pursuant to the description of the purpose of the relevant Real Gift selected by the Donor through the Charity e-shop. The Agreement shall be governed by these GTC, the Civil Code, and other generally binding legal regulations of the Slovak Republic.

 

  1. Charity e-shop is the Donee's donation portal on the website www.skutocnydarcek.sk, through which it gives the Donor the opportunity to provide the Donation to the Donee for the specific purpose according to the selected Real Gift. For the avoidance of doubt, the following shall be applied:

4.1 The Charity e-shop is a non-commercial activity of the Donee, through which it ensures the fulfilment of its mission and vision, sources of funding for its charitable activities, and spreads awareness and solidarity.

4.2 The Charity e-shop serves to obtain Donations from Donors, which the Donee uses to provide generally beneficial services.

4.3 The Charity e-shop is a symbolic and non-commercial donation portal through which no purchase contract or similar contracts for consideration are concluded, nor are any services provided between the Donee and the Donor, even for the benefit of a third party. 

4.4 When concluding the Agreement through the Charity e-shop, there is no sale of movable property or animals or provision of services, according to which the Real Gift – as the purpose of the Donation – is simply and symbolically named, nor is there a sale of a Gift Certificate, even for the benefit of a third party.

 

  1. Donation is a financial contribution, i.e. a monetary gift, which is the subject of the Agreement and which is provided gratuitously and voluntarily by the Donor to the Donee for its charitable activities in the provision of generally beneficial services by the Donee, as a non-profit organization in accordance with its statutes, and shall be used in accordance with the Donor's designation, as described in the purpose defined for the Real Gift selected by the Donor. The amount of the Donation and the purpose for which it is to be used shall be determined by the Donor based on the Real Gifts offer on the Charity e-shop.

 

  1. Order is a set of steps on the Charity e-shop through which the Donor selects a Real Gift, determines whether or not they are interested in a Gift Certificate, and confirms consent to donate the Donation to the Donee in accordance with the specified Real Gift under the terms and conditions set out in the Agreement, in particular these GTC. The Donor may place an Order even without registering on the Charity e-shop. For the avoidance of doubt, an Order does not constitute a proposal to conclude a purchase contract or a contract for the provision of services, or similar contracts for consideration, nor does it constitute their acceptance.

 

  1. Confirmation of the order is an action performed by the Donee, who sends an email to the Donor immediately after receiving the relevant Order via the electronic system of the Charity e-shop, confirming acceptance of the Order. The Confirmation of the order contains, in particular, summary information about the Order, such as the date of the Order, the Order number, the selected Real Gift - i.e. the purpose of the Donation and its amount. Along with the Confirmation of the order, the Donee shall also deliver to the Donor the text of these GTC, which form the Agreement. The Donor may also download the GTC at any time from the Charity e-shop at: https://www.skutocnydarcek.sk/podmienky-darovania/.

 

  1. Gift Certificate is a printed or electronic certificate for the Donation, which proves the provision of the Donation by the Donor to the Donee, as well as its amount in EUR and the purpose for which it shall be used. The Gift Certificate serves as confirmation of the Donation, expression of the thanks to the Donor for providing the Donation, spreads awareness and solidarity, and supports the fulfilment of the Donee's mission and vision. The Donor may voluntarily decide whether they are interested in the Gift Certificate for the Donation and, if so, determine its form – printed or electronic. For the avoidance of doubt, the following shall be applied:

(i) The Gift Certificate is provided to the Donor by the Donee free of charge, and the Donor is only required to bear the costs associated with the delivery of its printed form.

(ii) The Gift Certificate is not consideration for the Donation provided.

 

  1. Support service provider is the postal service provider Slovenská pošta, a.s., with its registered office at Partizánska cesta 9, 975 99 Banská Bystrica, Company ID: 36 631 124, registered in the Commercial Register of the District Court of Banská Bystrica, section: Sa, file no.: 803/S.

 

  1. Real Gift is a symbolic name for a specific category of Donation, defining the intended purpose of the Donation and its amount. The Donor therefore chooses the amount of the Donation and its purpose by selecting a Real Gift from the Donee's offer in the Charity e-shop, in the section https://www.skutocnydarcek.sk/darceky/. The Donee determines the current offer of Real Gifts at its discretion, which it may change at any time by changing its offer on the Charity e-shop. The Donee provides a description of the intended purpose of the Donation and its amount when offering a specific Real Gift, e.g., for the Real Gift 100% Goat, the Donee specifies the amount of the Donation as EUR 35 and states that the Donation will be used for the Livelihood aid program. For the avoidance of doubt, the amount specified for a Real Gift does not represent its total price or value, nor the price or value of the Gift Certificate, but determines the amount of the Donation – as a contribution by which the Donor supports the relevant aid program, e.g., in the case of a Real Gift 100% Goat, the amount of EUR 35 does not determine the price or value of the Goat, nor the price or other consideration for the relevant Gift Certificate, but defines the amount of the Donation in the amount of EUR 35, which the Donor will provide to the Donee when choosing this Real Gift, and the Donee will use it for the Livelihood aid program, namely for the direct, indirect, and administrative expenses associated therewith.

 

ARTICLE 3.

RIGHTS AND OBLIGATIONS OF THE Donee

  1. The Donee is entitled to:
  2. a) receive the Donation from the Donor via the electronic payment system of the Charity e-shop or other available payment methods,
  3. b) communicate with the Donor individually by e-mail, telephone, SMS, or through the Charity e-shop in connection with the Agreement and the fulfilment of the rights and obligations associated therewith;
  4. c) contact and inform the Donor about the use of the Donation, its impact on the lives of people in need, obtain feedback from the Donor and inform the Donor about its activities and charitable work, as well as about donation opportunities, by telephone, SMS, or email - in the interest of transparency, awareness raising, promoting solidarity, and individual care for the Donor; in this case, the Donor is entitled to refuse this at any time by sending an email to darcek@clovekvohrozeni.sk or office@clovekvohrozeni.sk, as well as each time the Donee contacts the Donor during a phone call or via the link provided in the email or SMS;
  5. d) inform the Donor if the payment of the Donation has not been successfully processed,
  6. e) withdraw from the Agreement if the acceptance of the Donation is in contrary to the ethical principles of the Donee, even after the Confirmation of the order, in such a case the Donee shall be obliged to return the Donation in full;
  7. f) withdraw from the Agreement if the Donor provided false, incorrect, or misleading information when concluding the Agreement, in such a case the Donee shall be obliged to return the Donation in full.

 

  1. The Donee shall be obliged to:
  2. a) comply with its obligations under the Agreement, in particular but not limited to the GTC,
  3. b) use the Donation for the purpose for which it was provided by the Donor, i.e. in accordance with the purpose specified by the Donor according to the selected Real Gift under the conditions specified in the GTC,
  4. c) provide the Donor with accurate, correct, and truthful information and, at the Donor's request, submit documents or other evidence confirming this information,
  5. d) at the Donor's request, inform the Donor about the use of the Donation within thirty days as of the date of delivery of the request,
  6. e) clearly, comprehensibly, and truthfully inform the Donor about the purpose for which the Donation is requested,
  7. f) return the Donation to the Donor if it has not been used in accordance with Article 3 par. (2)(b) of these GTC in the amount in which it was used in contrary to the agreed purpose,
  8. g) respond to the Donor's inquiries pursuant to Article IV par. (1)(e) of these GTC within 15 days at the latest.

 

 

ARTICLE 4.

RIGHTS AND OBLIGATIONS OF THE DONOR

  1. The Donor is entitled to:
  2. a) voluntarily provide the Donation through the Charity e-shop under the terms and conditions set forth in the Agreement, including these GTC,
  3. b) request information from the Donee about the use of the Donation provided,
  4. c) choose the purpose of use and the amount of the Donation by selecting the Real Gift,
  5. d) choose whether they are interested in a Gift Certificate and, if so, in what form,
  6. e) contact the Donee with any inquiries regarding the Donee's activities and programs, the use of the Charity e-shop, the Order or Confirmation of the order, the Real Gift, Gift Certificate, registration, Agreement, etc., by emailing at the address darcek@clovekvohrozeni.sk. The email must include the information necessary to identify the Order, namely its number and date, which the Donor received in the Confirmation of the order, if the Order has already been completed.
  7. f) contact the Donee if the Donation provided is used in violation of Article 3 par. (2)(b) of these GTC, In such a case, the Donee shall be obliged to return the Donation to the Donor in the amount in which it was used in contrary to the agreed purpose within 30 days as of the date of delivery of the Donor's request.
  8. g) choose the option of registering in the Charity e-shop as part of the Order process, in which case:

(i) the Donor shall determine their login details;

(ii) The Donor may cancel their registration on the Charity e-shop by sending a request via email to darcek@clovekvohrozeni.sk or office@clovekvohrozeni.sk;

(iii) The Donor shall have access to their personal card with an overview and details of all their Orders placed on the Charity e-shop;

  1. h) exercise their other rights arising from the Agreement, including these GTC or generally binding legal regulations.

 

  1. The Donor shall be obliged to:
  2. a) comply with their obligations under the Agreement, including these GTC,
  3. b) provide true, correct, and accurate information about themselves,
  4. c) pay the Donation in the amount determined according to the selected Real Gift under the conditions specified in these GTC,
  5. d) if they are an obligated person under Act No. 211/2000 Coll. on free access to information and on amendments to certain acts (the Freedom of Information Act), as amended, to immediately inform the Donee thereof by email at darcek@clovekvohrozeni.sk or office@clovekvohrozeni.sk.

 

 

 

ARTICLE 5.

ORDERING THE REAL GIFT AND PROVIDING THE GIFT CERTIFICATE

  1. When placing the Order, the Donor shall select the amount of their Donation and the purpose for which they want their Donation to be used, according to the range of Real Gifts on offer. The Donor shall place the Real Gift they have selected in a symbolic shopping basket and at the same time specify whether they are interested in a Gift Certificate for the Donation in accordance with paragraph 4 of this Article 5 of the GTC. If so, they select its form, either printed or electronic, or electronic in English, and select the appropriate method of delivery in accordance with paragraph 4 of this Article 5 of the GTC. The Donor shall also select the method of payment for the Donation under the conditions set out in paragraphs 3, 5, and 6 of this Article 5 of the GTC. The Donor shall then continue with the Order, filling in their details, confirming their consent to the Agreement, and sending the Order by clicking on the Complete Order button. Until the Order is sent (completed), the Donor may correct their Order at any time by returning to the relevant step of the Order process and entering the correct details. The Donor can check their choice of Real Gift in the Order summary. If the Donor is already registered on the Charity e-shop, their details will be automatically filled in when they log in to place an Order.

 

  1. The Donee shall confirm acceptance of the Order and its consent to the Agreement by sending the Confirmation of the order to the Donor's email address. If the Donor has chosen the Gift Certificate, the Donee shall send it to the Donor or prepare it for collection after the Donation amount has been credited to its account and the Donation has been registered, without undue delay, but always according to its internal capacities. If the Donor has chosen printed Gift Certificate, the Donee shall send it to them via the Support Service Provider or prepare it for personal collection. If the Donor has chosen electronic Gift Certificate, the Donee shall generate electronic Gift Certificate in PDF format and send the Donor an email with a link where it can be downloaded.

 

  1. The Donor may choose the method of payment for the Donation from the following types of payment, which are not subject to any fees for the Donor on the part of the Donee or the provider of the electronic payment system of the Charity e-shop, without prejudice to the provisions of paragraph 6 of this Article 5 of the GTC:
  2. a) payment by bank transfer to the Donee's account,
  3. b) payment by credit card online via the Charity e-shop's electronic payment system.

 

  1. For printed Gift Certificate, the Donor may choose personal collection in Bratislava at Baštová 5 or delivery via the Support Service Provider. For electronic Gift Certificate, the Donor may only choose delivery by email. If the Donor wishes not to receive the Gift Certificate, they should proceed as follows:
  2. a) select the printed version and delivery by email, or
  3. b) select the electronic certificate option and then do not download the PDF file sent to them by the Donee.

 

  1. When paying the Donation by bank transfer, the Donor is required to identify the payment under the variable symbol, which is communicated to the Donor in the Confirmation of the order.

 

  1. Overview of fees borne by the Donor:

- When paying the Donation by transfer to the Donee's bank account: according to the price list of the Donor's banking service provider (the Donor's bank), if they are charged to the Donor;

- When paying the Donation by payment card: according to the price list of the Donor's banking service provider (the Donor's bank), if they are charged to the Donor; 

- If the Donor has chosen printed Gift Certificate and delivery by post, they are also obliged to pay the costs associated with its delivery (postage) according to the current price list and conditions of the Support Service Provider.

 

ARTICLE 6.

FINAL PROVISIONS

  1. These GTC are published at https://www.skutocnydarcek.sk/podmienky-darovania/. The Donee is entitled to amend and supplement the GTC at any time at its own discretion; this shall not apply to completed and therefore sent Orders. The specific Agreement and all relationships related thereto shall always be governed exclusively by the GTC in the version published at the time of sending the Order (completion of the Order), which the Donee shall deliver to the Donor with the Confirmation of the order.

 

  1. By confirming their consent to the Agreement and sending the Order via the Complete Order button, the Donor voluntarily expresses their willingness to donate the Donation to the Donee under the conditions specified in the GTC and expresses their consent to the Agreement.

 

  1. In connection with the Order and the Agreement, the Donee, as the controller, processes the personal data of the Donor, as the data subject, for the purposes of: accounting, fulfilling legal obligations and protecting rights, recording mail, fundraising communication and care for the Donor, the Agreement between the Donor and the Donee, the contact form, disclosure obligations, registry management, and the operation of the Charity e-shop (cookies). Information about the processing of the Donor's personal data and their rights as a data subject, including the right to object to such processing by the controller, is published at https://www.skutocnydarcek.sk/podmienky-ochrany-osobnych-udajov/. Donor may exercise their rights as data subject by email or post using the contact details below:
